Seller Agreement

Last updated September 2026

This is the agreement you accept before your vehicle is published for bidding. It states plainly what you pay, what a winning bid commits you to, and what happens if your reserve is not met.

1. The parties and what this covers

This agreement is between you, the registered owner or authorised seller of the vehicle, and HawkMyRide, which operates the auction marketplace. It governs how your vehicle is listed, how bids are collected, what you pay and how the sale is settled.

HawkMyRide is not the buyer. The sale is between you and the winning dealership. We run the auction, verify the dealerships that bid, document the transaction and coordinate payment, title and transportation.

2. What you pay — Market A

Nothing. There is no listing fee and no seller success fee. The winning dealership pays an acquisition fee, which is why your proceeds equal the price you accept.

The only amounts that can ever be deducted are optional services you order yourself: a Verified inspection, or managed transportation if you ask us to arrange it. Each is quoted and confirmed by you in advance.

  • Accepted price $8,500 — you receive $8,500
  • Accepted price $15,000 — you receive $15,000
  • Accepted price $27,500 — you receive $27,500

3. What you pay — Market B

Listing your vehicle is free. If you accept a winning bid, HawkMyRide charges a seller success fee of 1% of the accepted price, subject to a minimum of $299.

The fee is deducted at settlement, so the amount you are paid is the accepted price less the fee. It is disclosed on the auction result screen before you decide, and again on the settlement statement.

You owe nothing if you decline the winning bid, if the vehicle does not sell, or if you withdraw before the auction closes. Relisting and every recovery step are free.

  • Accepted price $8,500 — success fee $299 — you receive $8,201
  • Accepted price $15,000 — success fee $299 — you receive $14,701
  • Accepted price $27,500 — success fee $299 — you receive $27,201

4. How your pricing market is assigned

HawkMyRide is testing two seller pricing structures. Market A charges the seller nothing. Market B charges a success fee of 1% of the accepted price with a minimum of $299, payable only on a completed sale.

Your market is assigned when your account is created and does not change for the life of your account. Your assigned terms are shown in the listing flow before you publish, on the auction result screen before you accept a bid, and on the settlement statement.

5. Disclosure and the binding nature of a bid

You must describe the vehicle accurately, including mileage, title status, lien payoff, accident history, mechanical condition and anything a dealership would reasonably want to know.

Accurate disclosure is what makes a winning bid binding. A dealership that wins may not renegotiate on the condition you disclosed. It may seek an adjustment only through the arbitration process, and only for a material issue that was not disclosed.

6. Reserve, acceptance and the recovery path

You set a reserve price, which is never shown to dealerships. When the auction closes you decide whether to accept the winning bid; you are never obliged to accept, and declining costs nothing.

If the reserve is not met, you may lower it and relist, post a fixed Buy Now price, or open a sealed final-offer window to dealerships. Every step on that path is free.

7. Settlement, title and payoff

On acceptance you must be able to transfer clear title. If a lien remains, the payoff is settled through the transaction and the balance is paid to you.

Funds are released once the vehicle, keys and documents have been handed over and the odometer verified against your disclosure.

8. Cancellation and withdrawal

You may withdraw your vehicle at any time before the auction closes at no cost. Once you accept a winning bid, the sale is binding on both parties, subject only to arbitration for material undisclosed condition or to a failure of title.

9. Records and consent

Accepting this agreement records the version you accepted, the vehicle it relates to and the date, against your account. The current version is seller-agreement-2026-09. If the substance changes, you accept the new version the next time you list.
